Representative James Abrams has co-sponsored a bill requiring the courts or a prosecutor to consider a defendant's cash contribution to a private non-profit charity when disposing of a criminal or motor vehicle case. Until two years ago, criminal and motor vehicle defendants could make donations to non-profits of their choice as part of their sentence. A tighter enforcement of the Victims Rights bill passed in the early 1990's required all defendants to donate to the Criminal Injuries Compensation Fund. A revised version of the bill would allow non-violent and motor vehicle offenders to choose to contribute to the victim's fund or to a non-profit. Jack Brooks, Executive Director of the United Way, was pleased with the revised version, since recent enforcement of the current law hurt the fund, as judges and prosecutors viewed monetary contributions as fines, not sentences, and ordered fewer of them. The new bill would bring dollars back into the United Way.
