Tracey Carey of New York recovered a judgment against Concorde Funding Group (a Connecticut mortgage lender). Little did she know her problems were just beginning when she began to enforce the judgment in Connecticut. When she tried to execute against Concorde's bank account at Greenwich Bank & Trust, they kept saying they had no money for Concorde, even though they continued to honor Concorde's checks. Carey's attorney, Houston Putnam Lowry, subpoenaed Greenwich Bank & Trust to a deposition to explain. The bank never showed. "Under our system of justice, no one can be above the law" said Lowry, a lawyer who frequently enforces judgments. "If they refuse to provide subpoenaed information, their certificate of authority to transact banking business should be suspended" Lowry further commented, shortly after filing a motion to that effect in the Stamford Superior Court. Lowry also asked Greenwich Bank & Trust's president be arrested and brought to court to explain the bank's actions. The Superior Court has not yet ruled on the motion.
